1. Acceptance of Terms

By enrolling in the KailoWay health coaching programme (“the Programme”) or using our website, you agree to comply with and be bound by these Terms and Conditions. If you do not agree to these terms, please do not participate in the Programme or use the website.

 

2. Eligibility to Participate

To participate in the Programme or use our services, you must be at least 18 years of age or of the legal age of majority in your jurisdiction. Participation is prohibited where it is not legally allowed under applicable laws.

 

3. Payment and Fees

• The Programme fee (“the Fee”) may be paid in full or in three equal monthly instalments.

• Payment plans must be arranged before enrolment, and failure to meet payment deadlines may result in suspension of services.

• No deposit is required for enrolment, and the full payment must be made within the specified payment terms.

 

4. Refund Policy

We offer a 30-day satisfaction guarantee:

• If you are not satisfied with the Programme within the first 30 days, you may request a full refund for the amount paid. No charges will apply, and you will not be charged for services rendered during this period.

• The refund amount will be transferred to your bank account and may take up to 14 days to process.

• After 30 days, you are fully committed to the remainder of the Programme, and no refunds will be issued.

 

5. Cooling-Off Period

Clients have a cooling-off period of 7 days from the date of enrolment to reconsider their participation in the Programme. During this time, clients may withdraw without any charges.

 

6. Responsibilities of Clients

Clients are responsible for:

• Providing accurate and complete information regarding their health, medical history, and any relevant conditions that may impact the Programme.

• Notifying KailoWay immediately of any changes in their health or circumstances that may affect their participation in the Programme.

• Actively participating in scheduled coaching calls and following the personalised plan to the best of their ability.

 

7. Medical Disclaimer

KailoWay is not a licensed medical professional. The services provided through the Programme are not intended as a substitute for medical advice, diagnosis, or treatment. Always consult with your physician or a qualified healthcare provider before making any changes to your health regimen or participating in the Programme. By enrolling in the Programme, you acknowledge that you are responsible for seeking appropriate medical advice as needed.

 

8. Non-Transferability

The Programme and all related services are non-transferable. The coaching and materials provided are intended solely for the client who enrols and cannot be shared or passed on to others.

 

9. Termination of Services

KailoWay reserves the right to terminate services or suspend participation in the Programme if the client fails to meet obligations, such as non-payment or failure to actively engage with the Programme. Clients will be notified of any termination of services.

 

10. Force Majeure

KailoWay will not be held responsible for failure to perform its obligations due to causes beyond its reasonable control, such as natural disasters, pandemics, or other unforeseeable events. In such cases, KailoWay will make reasonable efforts to resume services as soon as possible.

 

11. Indemnification

You agree to indemnify and hold KailoWay harmless from any claims, losses, damages, liabilities, or expenses (including legal fees) arising out of your use of the Programme or any materials provided as part of the Programme.

 

12. Limitation of Liability

To the maximum extent permitted by law, KailoWay is not liable for any indirect, incidental, or consequential damages resulting from your participation in the Programme. This includes but is not limited to loss of income, emotional distress, or dissatisfaction with the Programme.

 

13. Privacy and Communication

By enrolling in the Programme, you agree to receive emails, text messages, or calls from KailoWay related to your participation. Additionally, you consent to receive occasional marketing and promotional materials via the contact methods you provide. If you wish to opt out of non-essential communications, please notify us in writing. All personal data is stored securely and handled in accordance with our Privacy Policy.

 

14. Changes to Services

We may, without prior notice, modify the services, discontinue features of the Programme, or create new limitations. Any material changes will be communicated to clients.

 

15. Changes to Terms

We reserve the right to modify these Terms and Conditions at any time. Updates will be posted on our website, and your continued participation in the Programme constitutes acceptance of the modified terms.

 

16. Governing Law

These Terms and Conditions, and any claims or disputes related to them, are governed by and construed in accordance with the laws of Germany, without regard to its conflict of laws principles. All claims or disputes must be resolved exclusively in a court of competent jurisdiction in Germany.
